First thing, todayNote the damage on the delivery order or the airline's receipt, and give notice to the carrier immediately.
- Tell the insurer now, not after the assessment.
- Notice to the transporter in writing, within the time your policy sets.
- Every document within the time the insurer asks for it.
When you would claim
- Damage or shortage found on landing or at destination
- Container seal broken, or the container itself damaged
- Loss overboard, general average or salvage contribution
- Delay-related damage where the cover extends to it
What insurers most often rely on
- Notice to the carrier or port not given inside the time the contract of carriage sets
- Damage said to be pre-shipment rather than in transit
- Cover on terms narrower than the loss, because ICC (C) does not respond to what ICC (A) does
- Insufficient packing for a sea voyage
- Documents inconsistent with each other on quantity or description
On a transit claim most of them come down to a notice that was given in time or was not, which is a matter of record either way.
The documents
half of it belongs to the carrier13 items, and the carrier's papers matter here as much as the insurer's. Most of this list exists to prove the goods left whole and did not arrive that way.
- Claim form and the certificate of insurance
- Commercial invoice and packing list
- Bill of lading or air waybill
- Bill of entry or shipping bill
- Delivery order, and the survey or landing remarks
- Written notice to the carrier or port authority, and their reply
- Container interchange receipt and seal record
- Independent survey report
- Photographs at the port and at destination
- Cancelled cheque and bank details in the insured's name, for the NEFT payment
- Details of any other insurance covering the same risk
- A claim bill: the amount claimed, itemised, with the working behind it
- Damage or short-landing certificate from the carrier or the port
