Three deadlines
  • Tell the insurer now, not after the assessment.
  • The police the same day if anybody was hurt or the vehicle is gone.

When you would claim

  • Injury or death of a third party in an accident involving your vehicle
  • Damage to a third party's property
  • A tribunal notice or summons naming the owner or driver
  • A claim by your own paid driver or a passenger where covered

What insurers most often rely on

  • Driver not holding an effective licence for that class
  • Vehicle without a valid permit or fitness at the time
  • Breach of a fundamental condition, letting the insurer recover from the owner after paying the third party
  • The owner settling directly with the claimant
  • Late intimation of the tribunal notice

Most are answered by a document that existed on the day of the accident and is far harder to obtain a month afterwards.

The documents

  • Claim form and the FIR, charge sheet and post-mortem where relevant
  • Registration certificate, fitness, permit and insurance certificate
  • Driver's licence and its class endorsement
  • The tribunal notice, forwarded unanswered
  • Statement of the driver and of any witness
  • Photographs and the site sketch
  • Details of the injured or deceased where known
  • Cancelled cheque and bank details in the insured's name, for the NEFT payment
  • Details of any other insurance covering the same risk
  • The petition or the claim served on you, and the tribunal’s award if one has been made
Survey, then repairThe dates that decide a motor claim are the intimation, the survey, and the day the vehicle went in. Written down on the first day, that line settles the repair-before-survey argument before it starts.

Commercial motor claims are refused on paperwork far more often than on the facts of the collision: the licence, the permit, the fitness, the load.

Most often lost by: Authorising repairs before the survey, and discovering afterwards that the driver's licence was not valid for that class of vehicle.

There is no sum insured

Third-party death and injury carry no monetary limit in India; the tribunal decides. Property damage is capped, and the cap is small. Neither figure is anything you can change after the accident, which is why the file is the work.
